An appeal to from the NY Supreme Court article 78 decsion will be like $7,500 - $12,000. I'm trying to decide if I should keep fighting this. The judge accepted my explanation on appeal and awarded my permit. You've already gone through the appeals process, with a lawyer, and lost. IMO, unless you have a new lawyer that the judge owes a favor to, any more money you spend on this is just going down the drain.

Wouldn't an appeal be after a judges decision. Yes - but this pre-decision statement thing is highly unusual and the 30-day deadline is the same as an appeal - so I share Salt's concern that you are actually in the midst of an appeal process, despite the words of the licensing officer.
Even with legal representation his chances of getting it back are practically null. If he were to challenge the licensing officer's action of revocation--he would lose any appeal in state supreme court. BTW, Steve; in New York State it's not about gun rights to own but a privilege that can be taken away at any time and for any reason.
When I sent in the request for an appeal, I was given a time to see the judge, in the courtroom, after the normal court calendar. There was one other guy there who appeared to also be appealing a permit denial (it was hard to hear, I'm not sure). I spoke with the judge and explained the application discrepancy.

You will not get a pistol permit in NYS or any other state if addicted or using weed or any other drugs. There was just a lawsuit that said it’s unconstitutional but it will take a long time to get finalized in the courts. Normally you have a certain amount of time to appeal a denial before it is finalized. Normally it’s 30 days. Good luck.
Once your appeal is completed, THEN they say you can file for your UPIN. Can I apply for the VAF the same time I am appealing a NICS deny? You must first appeal your NICS denial decision. After the successful completion of your appeal, you will then be notified if you are a good candidate for the VAF.
