Do you need a Grant of Probate or Letters of Administration? A Grant of Probate is a Court order confirming that a person’s Will is valid and giving the executor authority to administer the estate. A Grant of Letters of Administration is made when a person dies without a Will. It appoints an administrator who is then responsible for the estate.
Probate is the legal process of proving that a deceased person’s Will is valid and confirming the authority of the executor (the person named in the Will) to administer the estate. Once approved, the Supreme Court of Western Australia issues a document called a Grant of Probate.
